MOUNTAIN COAL
COMPANY~~~.
A Subsidiary of Arch Western Resources, LLC
November 18, 2004
Mr. Jim Burnell
Colorado Division of Minerals and Geology
1313 Sherman Street, Room 215
Denver, CO 80203
RECEIVED
NOV 26 2004
Division of Minerals 8 Geology
West Elk Mine
P O Box 591
5174 Highway 133
Somerset, CO 81434
(970) 929-5015
Fax (970) 929-5595
RE: Mountain Coal Company L.L.C., West Elk-Mine; Permit C-80-007, West Flatiron _ _
Permit Revision No. 11, (PR-11), Response to the Division's Letter Dated 17 November 2004.
Dear Mr. Burnell:
Mountain Coal Company, L.L.C. (MCC) submits this response to the Division's question regarding
the difference in affected area and the Federal Lease Area of West Flatiron.
The existing approved Permit Area Boundary of the Federal Lease for Box Canyon (COC-56447)
PR-08, extended into the lease azea of the West Flatiron Federal Coal Lease (COC-67011) by
approximately 150 acres and this is the source of the issue you bring up. As stated in your letter to
me dated November 17, 2004, we may have confused things by applying for an additiona1540 acres
of permit azea and also stating that the affected area is 690 acres. The affected azea is not lazger
than the additional permit azea applied for. These two references should be the same number,
"approximately 540 acres". MCC has attached the enclosed drawing to clazify the difference.
I suggest this be an issue that MCC addresses as an adequacy response. If you have questions please
call me at (970) 929-2238.
Since ly,
G~
enry .
