Notice of Proposed Decision <br />The Colorado Division of Minerals and Geology (Division) has issued a proposed decision to <br />approve Bond Release Application No. 5 (SL-5) for the Raton Creek Mines, Permit No. C-1982- <br />055. Energy Fuels Mining Company operates the mine under the provisions of the Colorado <br />Surface Coal Mining Reclamation Act of 1979. Energy Fuels Mining Company submitted the <br />bond release application on August 8, 2005. This bond release grants approval for a partial Phase <br />I and a full Phase II and Phase III bond release (SL-OS) for 30.6 acres of disturbed azea, including <br />all permanent structures, ditches, and the single sediment pond, and about 117 acres of affected <br />azea within the permit azea at the Raton Creek Mine. The permit azea is 1,310 acres of which 30.6 <br />acres were disturbed during operations. The permit azea is located within portions of: <br />SWl/4, Section 31, T33S R63W; <br />All of Section 36 except portions of Wl/2,W1/2, T33S R64W, <br />All of Section b, T34S R63W; <br />Nl/2 NE1/4, NEl/4 NWl/4, Section 7, T34S R63W; <br />EI/2 E1/2, E1/2 SEI/4, Section 1, T34S R64W of the 6~h P.M. <br />The area is shown on the U.S.G.S Trinidad East, Colorado, 7.5 Minute Quad Map. The azea is <br />generally located about one mile southeast of Exit 11 along Interstate 25 south of Trinidad, <br />Colorado in Las Animas County. <br />The ownership of the land surface and the minerals for which bond release has been requested is <br />private. Reclamation of the disturbed land began in 1991 and permanent seeding was completed <br />in 1995. The Phase I portion of this bond release request applies to a number of structures and <br />features previously excluded from four, prior bond release applications (SL-O1 to SL-04) for <br />which the Division issued a decision and completed a written finding. This bond release (SL-OS), <br />if it becomes final, would terminate all jurisdiction of the Division and the MLRB at the site. <br />Copies of the proposed decision aze available for review at the Colorado Division of Minerals and <br />Geology office, 1313 Sherman Street, Room 215, Denver, Colorado 80203, and at the office of <br />the Las Animas County Clerk and Recorder. <br />Any person who has an interest that is, or may be, adversely affected may request an adjudicatory <br />hearing regazding this proposed decision. Requests for a hearing must be made in writing within <br />thirty (30) days of the first publication of this notice, and shall state with reasonable specificity the <br />reasons for the request and objections to the proposed decision. <br />
