Simpson <br />State Engineer <br />RE: C & M Companies, Distel Farm Resource, Permit No. M-89-029, AM-001 <br />Sections 7, 17, & 18, T2N, R68W, 6PM <br />Water Division 1, Water District 5, Weld County <br />We have reviewed the subject file for potential impact to local water resources. According to <br />the application, the proposed gravel mining operation will have dewatering trenches that will <br />expose ground water. Additionally, ground water will be consumed by evaporation, dust control <br />and water removed in the mined product. The original operation prior to this amendment had <br />a valid substitute water supply plan until December 31, 1993. As of the date of this letter, our <br />office has not received a request to renew the substitute water supply plan. <br />Prior to this office recommending approval of this project, a SEO approved replacement plan <br />(plan of substitute supply) or a decreed plan for augmentation will be required. Prior to <br />approvigg a gravel well permit, the applicant will need to obtain a waiver of objection from the <br />adjacent well owners within 600 feet or request a hearing before the State Engineer. <br />The amendment application also indicated that water from decreed water rights will be used as <br />storage in the lined gravel pits. The applicant will need to provide evidence to this office that <br />the water rights are decreed for storage in the subject gravel pits. <br />Please contact me at 866-45~4fs' if you have any questions or comments. <br />3sl;l kaNl <br />
