Through this civil action, Plaintiff Sierra Club <br />challenges the Department of finergy, Secretary Frederico Pena and <br />United Slates Army Corps of Engineers' failure to take necessary <br />steps to protect valuable wetlands, open space, and habitat for <br />the ''threatened" Preble's Meadow Jumping Mouse from a proposal of <br />expand a sand and gravel mine. The mine expansion will destroy <br />these natural resources. Thus, Plaintiff seeks declaratory and <br />injunctive relief against Defendants Department of Energy and <br />Secretary Federico Pena (collectively referred to as ^WE") for <br />violations of the Endangered Species Act ("ESA"), National <br />Environmental Policy AcL ("NEPA"), and Executive Order 11990 and <br />against Defendant Army Corps of Engineers (^Corps") for failure <br />to assert Clean Water Act ("CWA") section 404 jurisdiction over <br />SxaW Ammdcd Complaint <br />
