He <br />presented ATTACHMENT E, a January 9, 1984 evaluation of tF~e subsidence <br />potential (from the Plkeview Mine) in Colorado Springs. Mr. Case <br />discussed this matter further with the Board and answered their <br />questions. <br />In response to an inquiry from the Board, the Director said the <br />Division does not want to encourage development over potentially <br />hazardous areas nor deplete the limited resources which now composes <br />the fund by extending or changing the eligibility criteria. Staff said <br />the Division would like to transfer the responsibility of the Program <br />to an insurance company at some point in the future. <br />It was MOVED that the Board reaffirm the previous action of the Mine <br />Subsidence Protection Program by establishing the cutoff date for <br />permitted properties at February 22, 1989. As a result of that Meeting, Mr. Johnson <br />said he volunteered to draft a written notice of violation order. He <br />said the proposed Order, EXHIBIT A, had been presented tc the parties. <br />Mr. Johnson clarified that the record is closed, regarding this case, <br />with the exception that the Board requested that the Division provide a <br />status update, during this Meeting, about the detoxification issue. <br />Therefore, Mr. Johnson asked the Board to restrict tes~~imony to the <br />information addressing the status of detoxification, in order to <br />refrain from reopening the hearing to testimony provided during the <br />April 1992 Board Meeting. <br />
