Vigil's <br />association with Sunnyside Coal Company - Utah Sate Permit No. <br />ACT007007, violation dated 3/31/94. <br />Mr. Vigil is an officer of Energy Fuels Coal, Inc. ("EFCI") <br />operating in Colorado. Colorado's Division of Minerals and Geology <br />notified EFCI of this situation by letter dated November 27, 1995 <br />responding to EFCI's request for a minor revision to Colorado State <br />Permit No. C-81-014. Please note the following: <br />1) Mr. Vigil's resignation from Sunnyside Mines, Inc. <br />(parent company of Sunnyside Coal Company) and all <br />related subsidiaries effective date October 11, 1990; <br />2) Sunnyside Mines, Inc.'s Board of Director's resolution <br />accepting Mr. Vigils' resignation - action effective <br />date October 31, 1990; and, <br />3) Sunnyside Coal Company's Board of Director's resolution <br />accepting Mr. Vigils' resignation - action effective date <br />October 31, 1990. <br />Mr. Vigil has had no association with Sunnyside Mines, Inc. <br />nor any of it's subsidiaries since October 11, 1990 and the notice <br />EFCI received designates March 31, 1994 as the violation date. <br />I appreciate your prompt attention to clearing this situation <br />with the Office of Surface Mining's AVS. <br />Sincerely, <br />/ J',ames T.
