The request is made pursuant to Rules 1.8 and 1.9 of the Mineral Rules and <br />Regulations of The Colorado Mined Land Reclamation Board, For the Extraction of <br />Construction Materials, and Title 34 Article 32:5 Sections 112-and 125 afthe Colorado <br />Land Reclamation Act for the Extraction of Construction Materials. <br />It is the intent of the operator/ landowner, Gosney & Sons, Inc., to withdraw permitted <br />acreage of un-gained Land from its ~arrent permit in excharge for the same acreage <br />adjacent to the existing permitted lands (see attached maps). <br />The acreage to be withdrawn is referred to as "Phase II" of Amendment AM-0=~ (1998). <br />It consists of 19.3 acres. -The proposed exchange acreage as shown on the attached maps <br />is within the "Revised DMG Mining Limit" designation. This area consists of S'.8 acres. <br />Phase II has not been mined nor affected and remains as cattle pasture. It is the desire of <br />the operator/ I~ndawner9amaintain this area in its currer7t use. The exchange area abuts <br />the northwest section of Phase I (AM-03). Don L. Gosney is the sole shareholder of <br />Gosney & Sons, Inc (owner operator), and is the landowner of the exchange an~a. Until <br />recently, this area contained a few mobile homes and a residence also owned by the <br />shareholder. The mobiie$omes havetieen relocated off the site and the residence, in <br />significant disrepair, will be demolished or removed. There are no other permanent <br />structures within 200 feet of the proposed revised mining limits. <br />The pre-mining conditions of the exchange acreage, other than those mentioned above, <br />are identical to_those-found in Phases i, 9Land 9II. <br />P.O.
