Ms Topper stated two concerns in her letter. (1.) She requested
that her field imgation well, permit No. 32883 be the well tested for DIMP rather than
her domestic well, permit No. 2455. (2.) She is concerned that the sampling protocol;
used by Mr. Mark Molen to sample her well for DIlVIP may not be adequate.
The Division will schedule an item for the October 29-30, 2003 Mined Land
Reclamation Board Meeting for a Formal Public Hearing to recommend changing the
well to be sampled for DIlvIP. The Board's Order regarding approval of Amendment No.
1, condition No. 2 states "Aggregate Industries shall sample Kazen Topper's domestic
water supply well, Permit No. 2455, for DIMP prior to and after de-watering begins, and
shall submit the results to the Division and to Ms Topper within 30 days of the sampling
date." The Division will request that the Board change condition No. 2 of the order to
replace the words "domestic water supply well, permit No. 2455" with the words
"Irrigation well permit No. 32883." Prior to the Hearing, please express in writing to the
Division and to Ms Topper your agreement or disagreement with this proposed change.
The Boazd's October meeting will be held in Room 318, 1313 Sherman Street, Denver,
CO, at 10:00 am on the 29th and 9:00 am on the 30th.
On September 23, 2003, the Division received from ADCO Consulting your "Sampling
Results for DIMP on the Topper Property and Lake." In the report it is stated "the
samples were taken using the Colorado department of Public Health and Environment
Water Quality Control Division ground-water permit guidance suggested monitoring
well sampling protocol.
