1 <br />Current agency regulation and policy require that access routes, and claimant maintenance of those access <br />routes located on NFS land related to mining claims be covered either under an approved mining POO or <br />FLPMA Road Special Use Permit. Additionally, when commercial hauling activities are taking place on <br />a Forest System Road, a 7700-41 Road Use Permit should be issued to those operators hoping to use <br />system routes for commercial haul purposes. In order to legally authorize both the maintenance and <br />commercial hauling acfivities on this facility, the correct written authorization(s) must be in place. <br />For your use in making apre-application proposal for the commercial use and commensurate maintenance <br />of FSR228, I am enclosing a copy of our Standazd Form 299 which is used for submitting <br />proposals/applications for use of National Forest System lands and facilities. Completion of this form is <br />necessary to assess the full nature of your company's existing and proposed use of FSR228, as well as <br />determine if any environmental issues need to be addressed before authorizing the commercial use and <br />-maintenance of the road. Forest Service staff, including a hydrologist and road engineer, will visit the site <br />this spring with Mr. Welker to document the current condition of FSR228, and give professional advice <br />and direction on how to accommodate the commercial use and seasonal maintenance of FSR228. Once <br />we have your proposal (completed SF299 form and other necessary materials) we will be able to <br />determine the potential costs associated with its processing, which will be the responsibility of Colorado <br />Marble. <br />I look forward to hearing from you soon regarding the expectations Colorado Marble holds for the NFS <br />lands covered by your unpatented mining claims, as well as the intended future use of FSR228. Please <br />fill out the SF299 form and return it to this office as soon as possible.
