The following comments are provided: <br />1) The described impoundment structures, which are proposed to be 14 feet in height and <br />impound 2 acre-feet each, will be non-jurisdictional erosion control structures as defined in <br />C.R.S. 37-87-122 (1990). <br />2) These structures must be located on drainage channels determined by the State Engineer <br />to be normally dry (the Divsion Engineer can make this determination). <br />3) Pursuant to Rule 11 (Non-Jurisdictional Dams) of the "Rules and Regulations for Dam Safety <br />and Dam Construction" (September 30, 1988), the referenced structures may have minimum <br />freeboard requirements. <br />4) The referenced structures must meet the standard specifications for erosion control dams <br />on file in this office. <br />5) Construction cannot commence until the State Engineer has approved the erosion control <br />dam application pursuant to C.R.S. 37-87-122 (1990). <br />Provided the statutes and rules and regulations cited above are complied with, this office <br />has no objection to the referenced Technical Revision. <br />Sincerely,,;- / <br />c~t~~ ~.fJI~G~S <br />Chuck Roberts <br />Professional Engineer III <br />CR/jmg:6395 <br />cc: Ed Blank, Division 6 Office <br />
