<br />MINING NOTES AND RESTRICTIONS
<br />I. Installation of the conveyor and pipe crossing over the Fulton Ditch shall require
<br />DMG approval of a written agreement with the Fulton Irrigating Ditch Company. Prior to
<br />m m Ing be Ing undertaken In any area, excavate on setbacks w 1. be staked In the field to
<br />ensure relevant setbacks are followed.
<br />2. The existing wetlands area as shown on this map shall not be disturbed until a
<br />wetlands Inventory Is accepted by the Corp of Engineers and a 404 permit Is Issued
<br />allowing removal of any jurisdictional wetlands requiring the appropriate 404 permit. Any
<br />tall grass areas adjacent to wetland areas that are disturbed during mining shall be
<br />revegetated with Tull wheatgrass (Jose Variety) at a rate of 11.0 lbs. /acre.
<br />3, Site mining above the lake elevation level w111 use dry mining techniques using
<br />backhoes, bulldozers, and similar equipment, Below the water level, drag lines, backhoes,
<br />and /or dredges shall be employed for mining.
<br />4. Topsoil and overburden stockpl les that are temporarily stored or site In the S.

<br />proposed for firtai reclamation activities shall be placed out of the 100 year fioodplain
<br />in the northeast and southeast corners of the site. The grass seed mixture below shall
<br />be used for seeding of all topsoil and /or overburden stockpiles that are expected to be
<br />present for more than one year.

<br />5. Existing fencing shall be maintained and new fencing Installed to preclude easy
<br />access to the site. All new fencing will be in accordance with County regulations,
<br />Including obtaining fence permits, where required. Temporary Fencing around the existing
<br />wetland area shall be Installed and maintained. Operations an site shall also Include
<br />the Installation of a conveyor and wash pipe crossing of the Fulton Ditch, and the
<br />installation of temporary conveyors and internal roadways as needed.
<br />G. Excavated material shall be transported off -site to the existing Plant Site by
<br />conveyor, except by approval of Adams County for borrow material which may be transported
<br />off -site by truck via the site's existing entrance onto Brighton Road,
<br />7. Mining will Involve the striping and storage of topsoil and overburden, temporary
<br />excavation to a vertical condition (.5H, IV), that will Immediately be temporarily
<br />backfllled to at least IH11V, slopes If expected to remain for less than 1 year.
<br />Stoc-kplles expected to remain longer than 1 year shall be sloped to at least 3H,IV and
<br />temporarily revegetated. Areas below the water level will be backfllled with sand spoils,
<br />excess overburden, and silt from process water from the processing plant that is located
<br />on another portion of the permit area All final slopes shalt be a maximum steepness of
<br />3H:1V, and then a minimum of 6' of topsoil Shall be placed on all reconstructed areas
<br />above the existing lake water level.
<br />B. Per the Noxious Weed Control Plan In EXHIBIT D - MINING PLAN, noxious weeds will be
<br />controlled, particularly Diffuse Knapweed, Scotch Thistle, and Canada Thistle, which have
<br />been observed within the permit area and on adjacent property. All areas adjacent to
<br />roadways and waterways will be assessed every spring to determine the best management
<br />practice for weed control, At a minimum, all noxious weed areas will be mowed as needed,
<br />In heavily invested areas, approved herbicides will be applied as needed to include, but
<br />not limited to, Tordon 22K applied at 1 pt /ac at 20 gpa or 2,4 -D 44 amine at I qt /ac at
<br />20 gpa. Consultation with quallfled vegetation managers and /or county weed control
<br />coordinators will be on -going to assist in the management of noxious weeds.
<br />9. In the even of any spills from vehicles or other activities on site, the SPCC Plan
<br />Included as part of EXHIBIT D - MINING PLAN shall also be followed.
<br />10. No partial ciewatering shall be undertaken without agreement with shallow well owners
<br />within 600', or approval of the State Engineer's Office
<br />11. No mining shall occur within 2' of the ground water table In any area not already
<br />exposed to the surface until the State Engineer's Office approves a substitute supply
<br />plan or another plan that allows such exposure of ground water.
