BEFORE THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br />File No. C-84-065 <br />ORDER TO CONTINUE HEARING <br />NEW CASTLE ENERGY CORPORATION, PERMIT REVISION N0. 1 <br />The parties to this hearing having requested a continuance, the Mined <br />Land Reclamation Board ("Board") hereby grants the request for a continuance <br />and enters the following order: <br />1. This matter shall be set for a hearing at the December Board meeting, <br />and shall be consolidated with a hearing on the petition for a declaratory <br />order. <br />2. The Mined Land Reclamation Division ("the Division"), the New Castle <br />Energy Corporation and the Garfield Citizens' Alliance shall be admitted as <br />parties to the hearing. <br />3. Any other person with an interest which may be adversely affected by <br />the proposed decision shall be admitted as a party to the hearing upon the <br />filing of a request for a hearing, or a request for party status, by <br />November 23, 1990. Such request shall include the party's name, address and <br />telephone number. <br />4. By November 27, 1990 the Division shall forward a list of the parties <br />to each party. <br />5. By November 30, 1990, each party shall file with the Board, and mail <br />to each other party, a statement of the issues to be considered by the Board <br />on appeal. The statement of issues need not be lengthy or elaborate, but must <br />state the relief being requested, and the factual and legal grounds for such <br />relief. Failure to file such a statement may result in the loss of party <br />status. The Board, in its discretion, may exclude any issues not described in <br />the statement. <br />6. Any party may file a written brief on the issues by providing eight <br />copies of the brief to the Division, and a copy to each other party, by <br />December 5, 1990. <br />
