Long <br />Division Dvecwr <br />Pursuant to Title 34, Article 35, Paragraph 3, of the Colorado Revised <br />Statutes, the Division of Minerals and Geology hereby issues notice that on <br />January 5, 1993, a technical revision application for a permit to conduct coal <br />mining operations by Basin Resources, Inc., 14300 Highway 12, Weston, <br />Colorado 81091, was deemed complete for the purposes of filing. All reviews <br />and comment periods as provided in the Act and Regulations promulgated <br />thereunder initiate from this day of filing. <br />The applicant proposes to revise underground coal mining operations at the New <br />Elk Mine. The revision addresses a change in plant waste refuse disposal. <br />The operator wants to store underground the finer fractions of coal and coal <br />refuse from the processing plant. The process would involve a slurry pipeline <br />leading into the abandoned underground workings. <br />The New Elk permit area is located approximately 25 miles west of Trinidad, <br />Colorado, in the following sections: <br />Sections 13, 14, 21, 22, 23, 24, 25, 26, 27, 28, 34, 35 <br />and 36 of Township 33 South, Range 68 West; Sections 1 <br />and 2 of Township 34 South, Range 68 West; Sections 30 <br />and 31 of Township 33 South, Range 67 West; and Section <br />of Township 34 South, Range 67 West. <br />A11 sections are partially or fully projected by Basin Resources <br />due to the unsurveyed nature of the Maxwell Land Grant. <br />The above-mentioned tracts of land are shown on the USGS 7.5 minute Quadrangle <br />maps of Vigil, Tercio and Stonewall. <br />because the above referenced technical revision application might alter <br />previously approved permit conditions or mitigation measures, we are <br />requesting your agency's evaluation of the potential for impacts to threatened <br />or endangered species of plants or animals, or wildlife species otherwise <br />protected by federal law.
