'ItTe amendment application requests suthorvation to, among <br />other things, mine sand and gravel located within 200 feet of utilities or structures owned by Poudre <br />Valley REA Western Mobile is therefore required by the DMG to obtain the notarized agreement <br />of the utility or structure owner, in this case, Poudre Valley REA, that it understands that Western <br />Mobile shall compensate Poudre Valley REA for any damage to arty Poudre Valley REA utility or <br />structure alai may occur as a result of Western Mobile's mining and reclamation activities <br />associated with Mined Land Reclamation Pemut Amendment No. M-74-015. <br />in addition, and as you discussed with Mike Hart of Hart Environmental, as a threshold <br />matter, Western Mobile will take all reasonable precautions to ensure that Poudre Valley REA's <br />structures are rwt damaged during mining and we will provide Poudre Valley REA access to its <br />structures during the course of mining so that its structures can be adequately maintained. <br />If this is agreeable, please execute and notarize this letter and return it to me.
