We did not recommend that the rocks be removed <br />2 for a couple of reasons. Two main ones that we felt having the <br />3 operator remove those rocks would create a larger disturbance <br />4 than has already been created. <br />5 The second, was that we felt there was no significant <br />6 impacts to the hydrologic balance in that drainage. <br />7 CHAIRMAN DANIELSON: What's your recommendation in the <br />8 cease and desist order in the road area? <br />9 MR. BANTA: It would be for the same, we would <br />10 recommend that the cease and desist to not be issued to allow the <br />11 operator to proceed with the reclamation. <br />12 MR. O'CONNOR: IP that's the case that does not require <br />13 a motion, does it? <br />14 CHAIRMAN DANIELSON: I wouldn't think so. If we just <br />15 don't do anything. Is there anybody who wants to do anything on <br />16 that given staff's recommendations? All right. Then the next <br />17 question is the matter of corrective action. <br />18 MR. COOLEY: Mr. Chairman? <br />19 CHAIRMAN DANIELSON: Yes, sir. <br />20 MR. COOLEY: What is the cease and desist order? What <br />21 does it do? <br />22 MR. BANTA: Well, if somebody--at least my <br />23 understanding of this is, if somebody is mining in the area <br />24 outside of his permit boundaries, or he is dumping material into <br />25 a water core, the cease and desist order stops him from doing the <br />
