There ie a difference of opinion between CDM&G
and OSM regarding the final reclamation goals for Pit #1. CDM6G had approved
Technical Revision #7 and #10 authorizing a final deep valley configuration,
deviating from the original proposed configuration. The oSM representative,
Steve Rathbun, informed the group that the recontouring was a violation:
rather than reconstructing the large ridge, the pit was recontoured to the
standards approved in the CDM&G's technical revieione.
The technical revieione approved by CDM6G meet the land management objectives
of the BLM. The HLM ie the primary landowner (manager) of the land
encompassed by Pit #1. The existing pit configuration meets the HLM's land
management requirements for grazing and wildlife habitat. The site has been
recontoured to a shape which blends with the surrounding landscape and
topography. The change in watershed direction is minor, with all future
runoff remaining tributary to the Canadian River.
The Kerr Coal Company has complied with Technical Revisions #7 and #10 in good
faith. Requiring Kerr Coal to restore Pit #1 to its approximate original
contour will restore the shape of the land, but will not further improve its
value to the public. It is our recommendation that the CDMSG and OSM do not
issue a Notice of Violation to Kerr Coal.
If you have any questions regarding our positior. on this mat*_er, please
contact Jim Perry, Natural Resource Specialist, at the Kremmling Area Office,
(303) 724-3437.
Sincerely,
~ I C~.LCJ~LG'._-J~
h.,Y Bob Schneider
Acting District Manager
