To assist you're <br />your review changes made to the narrative portion of the application have be highlighted in <br />yellow. The accompanying revised exlribits are intended to be used as a progress review. ABer <br />your progress review is complete you will be provided full sized, signed drawings together with <br />additional copies ofthe other exhibits. <br />Based on prior conservations with you, a notarized letter is also attached from the land owner <br />requesting that the water supply line owned by the operator remain in place. <br />The following aze outstanding issues raised in your adequacy review that remain to be addressed: <br />Exhibit G -Water Information <br />The operator has recently obtained a new court decree for the revised well location. <br />Evidence of this will be provided to your office by December 19, 2003. The <br />documentation will also include an estimate of water requirement for the operation. <br />Extu~bit H -Wildlife Information <br />In the event that the concerns of the Colorado Division of Wildlife have with disturbance <br />in most of Phase VII can not be addressed, the mining and reclamation plan will be <br />modified so that there will not be any disturbance to the north-facing face neaz the Eagle <br />River in Phase VII. Phis issue will be resolved prior to December 31, 2003. <br />Exhibit J-Vegetation Information <br />A qualified botanist has been retained to provide estimates of cover and height of the <br />vegetative life forms found within most of Phase VII. The estimate will be provided to <br />your office prior to December 31, 2003. <br />
