Box 628
Nucla, CO 81424
Re: Preliminary Adequacy Review, TR-45, New Horizon Mine 2, Permit No. C-81-008
Dear Mr. Gubka:
The Division has completed portions of the preliminary adequacy review of your recent permit revision for the
design of sediment pond 009. The following items require consideration and /or additional input for the Division
to complete [he review of the technical revision:
1. As we discussed on [he phone, a reduction of acreage flowing into the pond is possible if runnoff from
undisturbed ground is diverted away from the pond, thereby reducing the size of the pond.
2. Across section of the pond embankment with elevations of sediment levels. principal spillway, and
emergency spillway levels is required to be submitted.
3. Justification for the reduction of the "C" factor in the soil loss equation should be included in the revision.
Once these items are addressed, the Division will continue the review of the pond design revision.
Should you have any questions regarding [his matter or are in need of additional information, please contact me.
Sincerely,
Harry B.
