Walther <br /> E.~eculive Director <br /> Michael B Long <br /> DIV~SIpn Director <br />RE: 6/22/99 Board Decision and Example Public Notices for TR-02, <br />Dalton Land and Cattle Pit, Permit No. M-87-064. <br />Dear Mr. (Dillon: <br />On 6/22/ff9, the Board denied Sandco's petition for Declaratory Order, requesting <br />exemption from the public notification process, typically associated with permit <br />Amendments but required by DMG for TR-02. Official notification of the Board's decision <br />and order will follow under separate mailing. However, the Board approved Sandco's <br />request to update the post-mining land use for the processing and stockpiling area, to <br />conform with county zoning conditions, as a Technical Revision subject to the following <br />two conditions: <br />1. Sarldco must waive its right to a decision on the TR within the standard 30 day <br />review period; and <br />2. Sarldco must satisfy the public, agency and landowner notice process that attends <br />submittal of an Amendment, including the four weeks of publication with the <br />standard public comment period, as described in Rules 1.6.2 and 1.6.5. Individuals <br />or 2lggrieved parties who are opposed to DMG's decision on the TR may request a <br />hearing before the Board through the appeals process. <br />The Boardl also requested that staff assist Sandco in the preparation of the public notices. <br />Therefore: staff have enclosed example notices for the following four required notices: the <br />Board of County Commissioners; the Board of Supervisors of the local Soil Conservation <br />District; the public notice to be published in a newspaper of local circulation and provided <br />to surface and mineral owners of the affected lands and surface owners of lands located <br />within 200' of the boundary of affected lands; and the notice required to be posted at the <br />mine site. These notices are required by Rules 1.6.2 and 1.6.5. <br />Pursuant to Rule 1.6.2(1)(c1, Sandco is also required to provide a complete copy of the <br />application for TR-02 to the County Clerk or Recorder's office, for public review. <br />
