W e have <br />identified the following concerns. <br />1. Central Appalachian Mining, LLC (CAM) will need to provide a certifietl !ward resolution verifying <br />that James D. Slater, President, is authorized to sign the bond. <br />2. Pursuant to Rule 2.08.6(2)(b)(ii) and 2.03.4(2)(a), please provide for insertion in the application the <br />name and address of CAM's appointed registered agent in Colorado. CAM will also need to obtain <br />a certificate of authority from the Colorado Secretary of State in order to transact business in <br />Colorado, and provide documentation that the certificate has been obtained. Finally, please <br />provide the names and addresses of CAM's designated permitting and inspection contacts for the <br />Munger Canyon Mine. <br />3. Please provide insertion/replacement instructions for Appendices A and B, and ensure that the <br />replacement pages are properly numbered for insertion in the permit. Note that the existing permit <br />Appendix A includes pages 11, 12, and 13 that address permit area land and coal ownership, <br />leasehold interests, right of way holders, etc, pursuant to Rules 2.03.4(6),(7), (8), and (g). This <br />information is not addressed in the SO application Appendix A, and the information will need to be <br />propedy updated for incorporation in the amended permit in conjunction with the SO. <br />4. In the proposed public notice, the last sentence of the 2ntl paragraph is extraneous and not <br />applicable; it should be deleted. <br />5. The cover letter indicates that CAM is in the process of securing right of entry documentation and <br />having other licenses and permits listed in Permit Appendix E assigned. Right of entry <br />documentation pursuant to Rule 2.03.6 will need to be provided for insertion in the permit in order <br />for the Division to approve the SO application. Documentation of notification of appropriate entities <br />regarding transfer of other licenses and permits required under Rule 2.03.10 is also requested. <br />6.
