This plan would have to <br />include a de;:cription of positive spill prevention efforts, provisions for spill <br />control, pro~dde immediate corrective action including spill control and <br />restoration of affected resources, and include separate and speciSc techniques and <br />schedules for cleanup of spills on the mine site and other properties. <br />Additionally;, under the Emergency Planning and Community Right-to Know Act <br />(EPCRA) (40 CFR Parts 370, 372) Arkins must make this information available <br />to the public. <br />Air Pollution - A large mine within a residential area would generate a large <br />volume of au•bome particulate matter. This presents a serious health hazard for <br />individuals whom suffer from respiratory ailments. Before the Colorado Division <br />of Mining and Geology can issue a new permit impacts on air quality must be <br />adequately addressed and the public must be allowed an opportunity to review <br />the compiled information. <br />• Employee Safety - A facility of the size that Arkins wants to create would present <br />numerous ha:rards to employees. Atkins must demonstrate to the citizens of the <br />State of Colorado and Atkins employees that a safe work environment would be <br />guaranteed. 'This information would be available to the public as a Occupational <br />Safety and Health Administration (OSHA) Emergency and Fue Prevention Plan <br />(20 CFR Para. 1910.38). <br />The aforementioned issues must be addressed suPliciently prior to the issuance of the <br />112 Mining Permut. LI'these issues can not be addressed and the public is not allowed <br />a chance to review and comment then this permit must be denied. The citizens of <br />Lyons, Boulder County, and the State of Colorado have a right to ensure that their <br />communities and the natural environment are protected from destruction.
