The reuest for <br />transfer of the permit contains most of the required information. <br />However, two inadequacies need to be addressed in order for the <br />Division to approve the permit transfer. <br />First, the information in Section 2.03.4 regarding financial <br />interests appears to have been prepared in accordance with an <br />outdated version of the Division's regulations (Rule numbers in the <br />transfer application correspond to the old rule numbers). Please <br />refer to the rules as revised in January, 1991 and revise the <br />relevant parts of section 2.03. In particular, information about <br />the corporate officers of KN Energy, the dates they assumed their <br />roles and employer ID numbers need to be added. <br />Secondly, additional information regarding insurance will need to <br />be supplied. The Canadian permit currently contains a statement of <br />self-insurance as of January 8, 1986. A more current statement <br />needs to be submitted which indicates that Slurco and the Canadian <br />Strip Mine in particular are insured as required in Rule 2.03.9. <br />In addition, a financial statement for KN Energy needs to be <br />submitted so the Division can determine whether the company has <br />sufficient capital reserves to be self insured. The permittee <br />should be aware that the Division will require submittal of <br />financial statements on an annual basis for this purpose. <br />The bond transfer information submitted appears to be in order. <br />Once the Division reviews and approves the information mentioned <br />above, the transfer and bond documents can be accepted. At that <br />time, documents signed by the Division Director will be returned to <br />the company for the appropriate signatures. <br />
