modified the Amendment Order in October 2603 to designate the proper well to be tested <br />for diisopropylmethylphosphate ("DIMP"). <br />3. The Objectors now request further modifications to the Conditions to reflect what the <br />Objectors describe as a misunderstanding concerning the frequency of well testing. After <br />further discussion and input from the parties as well as the Division, it is apparent that the <br />water sampling location and frequency should be modified to achieve the desires of the <br />parties. Specifically, the water sampling location described in Amendment Order Condition <br />No. l should be changed from the gravel pit pond water to the Objector's alluvial irrigation <br />well, permit no. 32883. Monitoring of that well should be conducted quarterly for a period <br />of two years, after which the Operator should submit a technical revision to the Division to <br />determine future sampling. Condition No. 2, which, as modified, required testing of the <br />Objectors alluvial irrigation well, should be eliminated. <br />4. The Operator has no objection to the proposed modifications. <br />5. For good cause shown, it is appropriate to modify fhe Amendment Order as set forth below. <br />Condition No. ] should be revised to read as follows: <br />No dewatering or extraction activities will occur until Aggregate Industries <br />develops a plan to monitor Karen and Ralf Topper's irrigation alluvial well, <br />permit no. 32883, for diisopropylmethylphosphate (DIMP) and obtains <br />approval of that plan from the Division of Minerals and Geology. The plan <br />will include quarterly sampling and analysis and shall begin immediately after <br />dewatering and/or extraction activities are started. The quarterly monitoring <br />will continue for two years. At the end of two years, Aggregate Industries <br />shall submit a technical revision to the Division to determine future sampling. <br />The plan will include the sampling and analytical methods to be used and an <br />agreement to submit the results of the analysis to the Division within 30 days <br />of the sampling date. The samples will be obtained and analyzed by a <br />company, individual, or agency certified to do the work. If an analysis shows <br />a level of DIMP exceeding Bug/L, Aggregate Industries or its agent will <br />immediately notify the Division by certified mail and include a response plan <br />to deal with the contaminant, and to prevent on-site and off-site damage. 1f <br />the Division determines from the monitoring data that there is reasonable <br />
