• 1141111411111111111 • <br />t_ ', ~ ~ 1 <br />~~ <br />DATE: 9/22/95 obi ~ ~ ; .: _ _ <br />TO: Memo to File M-86 ~ Cugnini Pit <br />FROM: Wally Erickson +~~' <br />RE: TR-O1, SI-O1, Inspection Report 9/20/95. <br />Don Gosney, operator of the Cugnini Pit, submitted application letter with map for TR-Ol on <br />9/14/95 to DMG field office in Durango. The original application for TR-Ol requested 2.7 acres <br />of affected/reclaimed area be returned so that the operation could advance 2.6 acres beyond the <br />current permit boundary. Mr. Pat Cugnini, landowner, had requested that Mr. Gosney continue <br />the operation an additional 2.6 acres. Mr. Cugnini stated his request in a meeting with Mr. <br />Gosney and DMG inspectors Tom Gillis and Wally Erickson at the DMG office in Durango. Mr. <br />Cugnini requested that the north perimeter of the affected area be extended approximately 2.6 <br />acres to remove a small "ridge" that would otherwise result from the existing mining and <br />reclamation plans. Mr. Cugnini stated that removal of [he "ridge" would enhance the post mining <br />land use. Mr. Cugnini also stated that he intended to utilize a portion of the reclaimed area as a <br />feeding area for livestock. During the meeting DMG discussed options of TR or Amendment with <br />Mr. Gosney and Mr. Cugnini. <br />Original submittal of TR-Ol occurred 9/14/95. Original submittal requested return of 2.7 acres of <br />reclaimed affected area and 2.6 acre extension to the north permit area. The application was not <br />accompanied by payment for TR fee. I called Mr. Gosney to. inform him that TR fee for Regular <br />112 permits was $150, and that TR-Ol was actually requesting release of reclamation liability and <br />release of financial warranty for the 2.7 acres area returned. I informed Mr. Gosney that DMG <br />could not approve TR-O1 until the 2.7 acre area had been approved for release of financial <br />warranty. <br />DMG received written request for release of performance and financial warranty for 2.7 acres on <br />9/20/95. DMG conducted warranty release inspection on 9/20/95. DMG received a modified, <br />second submittal for TR-O1 9/21/95, requesting 2.6 acre addition to north boundary, following <br />release of 2.6 acres for SI-O1, second submittal of TR-Ol also requested a change in post mining <br />land use from rangeland to winter feeding area. <br />TR-Ol =Revise Post Mining Land Use for 2.6 Acres and Revise Perimeter of Affected Area. <br />SI-Ol = Release 2.6 acres. <br />TR-O1 and SI-O1 approvals will occur simultaneously. <br />
