Surety Increase 1 (SI-1) and Technical Revision 66 (TR-66) -Extension of Time
for Submitting Letter of Credit
Deaz Mr. Tonozzi:
The Division has received the 8 November 2006 letter from Jack Welch of Rio Tinto
Energy America (RTEA) regarding RTEA and Colowyo's request for the posting of the
letter of credit for the reclamation liability at the Colowyo Mine. Basically, RTEA and
Colowyo aze asking the Division to waive and/or modify the requirements for the posting
of a letter of credit. The Division has sent the request letter to the Colorado Attorney
General's Office and asked for a determination as to whether the Division could accept
RTEA and Colowyo's request. The Division has not yet received a determination from
the Attorney General's Office.
Since RTEA and Colowyo have made agood-faith attempt to post the appropriate letter
of credit by the agreed upon deadline of 8 December 2006 and the subsequent 8 January
2007 deadline; and since the Division is waiting for a determination from the Attorney
General's Office; the Division is granting RTEA and Colowyo a 32 day extension for the
submittal of an appropriate letter of credit or corporate surety. The new deadline for the
submittal is now 9 February 2007.
