Cattany <br />Division Director <br />Natural Resou¢e Trustee <br />Meeker, CO 81641 <br />Re: Colowyo Mine C-1981-019 <br />Surety Increase 1 (SI-1) and Technical Revision 66 (TR-66) -Extension of Time <br />for Submitting Letter of Credit <br />Deaz Mr. Tonozzi: <br />The Division has received the 8 November 2006 letter from Jack Welch of Rio Tinto <br />Energy America (RTEA) regarding RTEA and Colowyo's request for the posting of the <br />letter of credit for the reclamation liability at the Colowyo Mine. Basically, RTEA and <br />Colowyo aze asking the Division to waive and/or modify the requirements for the posting <br />of a letter of credit. The Division has sent the request letter to the Colorado Attorney <br />General's Office and asked for a determination as to whether the Division could accept <br />RTEA and Colowyo's request. The Division has not yet received a determination from <br />the Attorney General's Office. <br />Since RTEA and Colowyo have made agood-faith attempt to post the appropriate letter <br />of credit by the agreed upon deadline of 8 December 2006 and the subsequent 8 January <br />2007 deadline; and since the Division is waiting for a determination from the Attorney <br />General's Office; the Division is granting RTEA and Colowyo a 32 day extension for the <br />submittal of an appropriate letter of credit or corporate surety.
