Tower Pit No. 1 Permit No.M-1977-436, <br />-001 <br />Dear Mr. Bramble: <br />The Division has received your letter of August 24, 2000 on August 29, 2000 regarding the Camas Tower Pit <br />Amendment. We are responding to your comments as follows: <br />1. We are sending a copy of your letter to the applicant and will ask them to revise the distance to <br />the City of Brighton. We will also give them the opportunity to respond to your concems. Any <br />responses will be forwarded to you. <br />2. The Division does not have any control over noise or impacts on air quality. Noise issues are <br />the responsibility of the Country and most air quality and dust issues should be directed to the <br />Air Quality Control Division of the Colorado Department of Public Health and Environment. <br />Although we understand your desire [o see a wet mining operation, the Division does not have <br />the authority to determine the type of mining method to be used. <br />3. The Division's Rules and Regulations require a 200 foot buffer from structures unless the <br />applicant can show that mining closer will not impact the structures stability. The set back <br />impacts to the hydrologic balance caused by flooding of the river and subsequent flows of the <br />floodwaters into the pit will be evaluated. There is also a possibility that the Urban Drainage <br />and Flood Control District may have some set-back requirements. <br />4. The Construction Materials Rules and Regulations Rule 3.1.3 requires that "All reclamation <br />shall be carried to completion by the operator with all reasonable diligence, and each phase of <br />reclamation shall be completed within five (~) years from the date the operator informs the <br />Board or Office that such phase has commenced, unless extended by the Board or Office." The <br />timetable for mining and reclamation on page 13 of the application shows three phases with <br />mining ending in phase I after 3 years. Phase 2 after 8 and Phase 3 after 9. Therefore, it <br />appears that reclamation on Phase one will store in 3 to 4 years. <br />In response to your request for natural vegetation and trees of four inch caliper or greater be <br />planted within the 600 foot buffer area as a noise and environmental barrier, the Division has no <br />authority to require reclamation work or the plantings beyond the areas disturbed by the mining <br />activity. <br />Since your letter expressed your issues as "concerns" rather than "objections" it is not clear if you wish <br />to become a formal objector with parry status. Please refer to page 2, Paragraph II in the enclosed <br />
