The Forest <br />Service consented to the BLM modifying these leases under an Environmental Assessment and <br />Decision Notice and Finding of No Significant Impact. The regulations call for the CDMG to <br />secure the concurrence of the surface management agency prior to adding lands to a permit area. <br />This letter is to confirm that we concur with adding the lands described in TR-95 to MCC's <br />permit area to allow mining of pane] 17 in the B seam. Please note that Map 1 A enclosed with <br />the TR-95 submittal does not clearly show the technical revision area. <br />We find that Maps 51 and 52 enclosed with this submittal show that MCC projects mining <br />Longwell panels in both the E and B seams under the southern portion of the lease modification <br />areas (lands not proposed for addition under this revision). The mine plan provided by MCC for <br />use in our NEPA analysis for the lease modifications did not include overlying panels in both <br />coal seams, thus our analysis did not evaluate the surface effects of subsidence resulting from <br />multiple seam mining in these areas.
