The Division proposes to deny the Phase II Bond Release at <br />the mine site, primarily because of the likelihood that the diversity standards will not be met <br />without additional revegetation. The additional seeding required to meet the diversity standard <br />will possibly necessitate significant re-disturbance. Therefore, you are advised not to reclaim <br />the existing sediment ponds at the mine site prior to establishment of a more diverse stand of <br />vegetation. <br />As an additional note, the permit currently requires backfilling and grading of the No. 1 Mine <br />Portal Area. If it is your intention to reclaim this area in another manner, you must submit a <br />technical revision to that effect. Please be advised, however, that the Division is not inclined to <br />approve leaving the portal area as it stands. Therefore, the TR should provide for securing the <br />portal area and protecting it permanently from public access. The TR should also include <br />backfilling and grading. <br />Finally, reclamation of the road leading to the portal is not addressed in the permit application <br />package. Although the road is reported to have been installed pre-law, it was in use during the <br />permit term and, as such, should be reclaimed in accordance with the requirements of <br />Rule 4.03.2(7), unless the conditions of Rule 4.03.2(11(f) apply.
