Cattany
RE: Seneca II-W Mine (Permit No. C-1982-057) Division DirecTOr
TR-49 Remaining Adequacy Issues Natural Resource Trustee
Dear Mr. Karo:
We have reviewed the information submitted in your response package of March 23, 2005,
on the remaining TR-49 adequacy items (2 and 5), and we find the responses to be
satisfactory. With respect to Item No. 2, we believe the circular failure analysis, which
indicated a factor of safety of less than 1.3, may be more appropriate than the block failure
analysis, which indicated a factor of safety in excess of 1.3. However, based on the
factors discussed in your letter and the stability analysis attachment, we will not require
further analysis or slope reduction at this time. Re-evaluation will be required if there is
future evidence of instability.
Regarding Item No. 2, we acknowledge and concur with the decision to submit the "as-
built" report for the two pond 016/016A system within the PR-5 application, rather than the
TR-50 application.
We have no further review comments, and we will proceed with issuance of a proposed
decision to approve TR-49. Please let me know if you have any questions.
Sincer
Daniel T.
