Savage: <br />This responds to your letters of August 1, 2007 requesting site disqualification under the <br />authority conferred to the U.S. Fish & Wildlife Service (Service) by the Endangered Species <br />Act of 1973 (ESA), as amended (16 U.S.C. 1531 erse .}for the Hall-Irwin Corporation's <br />Long Resource rmneral extraction site neaz Windsor, eld County, Colorado. <br />Based on the information provided, the Service agrees that a population of Preble's (Zapus <br />hudsonius preblei) is not likely to be present within the project site. In addition, based on the <br />negative results of the Ute ladies' tresses orchid (Spiranlhes diluvialis) survey the Service <br />concludes thatPreble's or the Ute ladies' tresses orchid are not likely to be adversely affected. <br />Thus this site is disqualified for consideration under provision of ESA. Should additional <br />information regarding listed or proposed species become available, this determination may be <br />reconsidered. <br />On February 2, 2005 the U. S. Fish and Wildlife Service issued a 12-Month finding on a <br />petition to delist Preble's. Because of the complexity involved, the Service extended its <br />original proposal.
