Our recommendations for approval of the permit conversion are <br />itemized in the enclos~:d Attachment A, Special Stipulations. We believe that <br />reclaiming the highwal:l in the phase I area to a 1:1.25 slope and leaving a <br />potential pond will inhibit Moffat Limestone Company's ability to adequately <br />revegetate the lands. We would like to rely on the enclosed reclamation <br />standard to mitigate potential problems and leave room for discussion of other <br />alternatives. We reco:amend a bond of $20,000 or $2,000 per acre. With <br />inclusion of these stipulations, we have no objection to approval of the <br />permit under the Memorandum Of Under-standing (MOU) between our agencies for <br />operations under the mining laws. <br />If you have any concerns, please call Janet Hook at (303) 824-4441. <br />Sincerely, <br />David K.
