This property has been mined under a special use
zoning permit issued by Boulder County (Docket SU-88-14, amending
Docket SU-81-10) , and a reclamation permit issued by the State
(Permit Number M-81-302, as amended) .
At the public hearing held before this Board on November 26,
1996, Western Mobile stated that it was preparing to submit an
application to amend the existing reclamation permit which would
include the heightened berm. In a subsequent telephone
conversation with DMG staff, our County Attorney's Office
confirmed that this application had indeed been filed, and that
DMG considered it to be not a technical revision to the
reclamation permit, but an amendment. We understand that DMG and
MLRB will process the request accordingly.
By this letter, we wish to inform you that the
Board of County Commissioners remains very concerned with this
matter and with any action which you may take on the referenced
amendment application. The County requests to be notified of the
progress of any such application in accordance with the MLRB's
1
Jana L.Mendez Ronald K.Stewart Paul Danish r
County Commissioner County Commissioner County Commissioner
