Rationale for Recommendation for Approval, Over Objections <br />Colorado City iVletropolitan District 110-112 Permit Conversion Application, <br />Mountain Shadow Pit, Permit No. M-1979-158 <br />Submitted July 12, 2000 <br />Introduction <br />Colorado City Metropolitan District's (CCMD) conversion application was found complete and <br />considered filed with the Division on January 10, 2000. The application proposes to increase the size <br />of their presently permitted sand and gravel mining operation from 9.9 acres to 40.155 acres, and <br />change the permit type from Limited Impact (110 permit) to Regular (112 permit). The District is <br />under an Order by the Colorado Mined Land Reclamation Board to complete the conversion of their <br />permit by July 27, 2000, to satisfy a corrective action in Notice of Violation MV-2000-009. The <br />District waived its right to a decision within 90 days of filing the application. The site is located <br />northwest of the intersection of Greenhorn Road and Mountain Shadows Drive, in Colorado City. Nc <br />asphalt or concrete hatching operations are included with the application. No bulk fuel or other bulk <br />petroleum product storage is included in the application. The depth of mining is expected to be 25 to <br />30 feet. <br />CCMD owns the surface of the land to be affected by this operation as well as the subsurface rights <br />and as such, has legal right-of-entry to conduct the proposed mining and reclamation activities, except <br />on land where easements may restrict such activity. <br />I.
