Simpson, Assistant State Engineer <br />SUBJECT: Amendment to Henderson Mine, Climax Molybdenum Company <br />#77-342 <br />As requested by your office, we have reviewed the application for an <br />amendment to the Henderson Mine near Empire. The applicant appears <br />to have sufficient water rights under Water Court Case No. W-526 to <br />meet the proposed needs of the project and to construct the reservoir <br />on Lost Creek. We, therefore, have no objection to the proposal at this time <br />provided the project and its proposed amendments are operated in accord- <br />ance with the above mentioned water court case and its stipulations and <br />all appli~ble state water statutes. <br />-SQL _-r AYE. <br />Hal D.
