I have gone over all the violations and then checked them with the two stipulations that Bowie No.
2 has attached to its permit. I think that we should terminate the two stipulations and [rake one new
one. Here is why:
Stipulation No. 7 lists these 3 items-
l) KENTUCKY CITATION NO. C98-081-414-OOI, ASSOCIATED WITH STAR FIRE MINING
COMPANY;
2) KENTUCKY FORFEITURE, CESSATION ORDERS NOS. 050265 AND 050320 AND C[VII.
PENALTIES NOS. 052522, 052908 AND 053099 FOR PERMIT NO. 8980140, ASSOCIATED
WITH CATAWABA INDUSTRIES;
3) WEST VIRGINIA CESSATION ORDER NO. 031-C FOR PERMIT NO. S012782,
ASSOCIATED WITH CANNELTON INDUSTRIES INC.
Item 3 no longer is associated with Bowie Resources.
Stipulation No. 8 lists these 3 items -
1) VIOLATIONS AND FORFEITURES UNDER THE PITTSON SETTLEMENT:
A) VIRGINIA FORFEITURES FOR PERMIT NUMBERS 1200724, 2339, 2503, 3053-U, 3394
AND 1200551,
B) VIRGINIA VIOLATIONS NUMBERS C80-OOl-Ol8-004 AND C80-001-O18-005,
C) WEST VIRGINIA FORFEITURES FOR PERMfp NUMBERS 0035700 AND 0074400
But there are now two more West Virginia permits listed under the Pittston Settlement for other
violations.
