Long
Division Direnor
Deaz Mr Tifft:
The Division has received and reviewed your request for modification of Notice of Intent for coal
exploration NOI CX-96-219-01. We find that your request for modification is complete, but
several items are still required to make the request adequate for approval. These adequacy
concerns are listed below.
1. Please submit the azcheaological clearance for the new sites to CDMG at the same time it is
submitted to the USBLM. Several of these new sites are as far as one mile from previously
cleared sites, and hence should receive discrete clearances.
2. Please submit surface access cleazances to the CDMG.
3. Please obtain clearances from both the US Fish and Wildlife Service and the Colorado
Division of Wildlife regarding threatened and endangered species. Existing stipulations are
already in place for previously-cleared sites regarding raptor nests, grouse leks, and gated roads.
Again, the location of some of these sites will require that they receive individual clearances
from these agencies.
Regazding the bonding requirements, a representative of the Division participated in an
inspection in the fall of 1997 that included most of the previously cleared drill sites and the
access roads. Based on our observations from that inspection that much of the reclamation has
been accomplished on the sites, we feel that the existing bond is sufficient to cover the activity in
the modification.
If and when questions arise, please feel free to call me at the Division.
Sincerely/`~ ~ ~/~
o L-C y'
Jim Burnell, Environmental Protection Specialist
