Go d Mining <br />Placer - 200 acres, Alma Placer <br />Dear Mr. Oehler, <br />Colorado Division of Wildlife personnel have reviewed the above ref ere ced mining <br />application as well as the mining site- Based on this review, I am of Bring the <br />following comments. <br />It appears Reclamation Resources Inc. (R.R.I-) has already constructed settling <br />ponds for the operation in question. In so doing, RRI has created sev rat serious <br />problems. The primary sediment pond berm appears to be in violation o Clean Water Act <br />404 b(1) guidelines since it touches the stream bank of the bfiddle For of the <br />South Platte and has inundated significant square footage of wetland-r parian <br />habitat. In doing the foregoing, RRI has already violated its pro)iose berm to <br />streambank 50 foot buffer. It also appears that RRI has committed a roperty <br />injury" to the Colorado Division of Wildlife which has a 66' Right of ay Ease- <br />ment for public fishing along the Middle Fork of the South Platte. Th s Right <br />of Way Easement, in part, constitutes a portion of the Alma State Wild ife Area. <br />Other concerns and recommendations are as follows: <br />1. The sediment pond berm, because of its proximity to the river its steep <br />banks and soil composition, presents a very real erosion and ater quality <br />threat, and a high potential for a breach. <br />2. The wa lit roblems or s 11 toxlclt <br />problems due to high concentration of heave metals. Should t e pond be <br />lined? <br />3.
