<br />2) (cont.) <br /> <br />rights to store the volume of the permanent pool water at the Center and <br />West Ridge Ponds? <br />Attached are photocopies of Chevron U.S.A., Inc.'s water storage <br />rights applications for the West and Center Ridge Ponds submitted <br />to the District Court, Water Division No. 6, Colorado, for review and <br />approval. It is estimated that regulatory review and approval may <br />take up to a year. Copies of the approved water rights applications <br />will be forwarded accordingly. However, if water rights approval <br />is not granted prior to the end of the 60-day extension period, P&M <br />requests stipulated approval of the submittal. <br />3) P&M should revise Section 4.6.11 (page 4.6-147) of the permit <br />application package. The Center and West Ridge Ponds should be excluded <br />from the statement that all sediment ponds will be removed. <br />Text on page 4.6-147 of the approved permit has been modified to <br />reflect the retention of both the Center and West Ridge Ponds as <br />permanent impoundments, and subsequent exclusion from removal. <br />4) Pages in Appendices 4.6-N and 4.6-0 should be numbered on every <br />page, consistent with the currently approved permit application package. <br />Pages in Appendices 4.6-N and 4.6-0 respectively, have been <br />numbered. <br />5) The reclamation performance bond for the Center and West Ridge <br />Ponds will not be released until vegetation on the embankments and slopes <br />meets all applicable success standards. Observations over the past <br />summer indicate that the vegetation currently established on the pond <br />embankments may not meet bond release requiremenfs. The Center Ridge <br />Pond embankments and sideslopes should be seeded with the currently <br />approved permanent seed mix. Vegetative cover will be deemed <br />successful when at or above 47%, as stated on page 4.4-4 of the approved <br />permit application. The West Ridge Pond embankments and sideslopes also <br />should be seeded with the currently approved permanent seed mix. <br />Revegetation of the West Ridge Pond area will be deemed successful when <br />it meets the permanent program criteria outlined in Section 4.4.2.1 of the <br />
