However, Resources is also the permittee for two
limestone quarries; the Mid-Continent Quarry and the Marblehead
Quarry. Both quarries are referenced in the liquidation plan.
Issues have arisen about the current status of both operations
and about the bond on the Mid-Continent Quarry.
In section 2.5 of the plan, the class 5 claims include those
which pertain to the coal mine site and the quarries. The plan
specifies that the class 5 claims shall include amounts arising
under the permits and amounts required under Resources' current
performance bond to which the Division may now or hereafter be
entitled.
The liquidation plan further states that the claim
concerning the Mid-Continent 4uarry is secured by a deed of trust
limited in the amount of $7,000, and that the claim pertaining to
the Marblehead Quarry is secured by two certificates of deposit
in the approximate amount of $4,500. Section 2.5.
The Division received a check for $7,000 in regard to the
Mid-Continent Quarry some time ago. As to the Marblehead Quarry,
the Division's files only show that the Division holds one
certificate of deposit in the amount of $2,500.
STATE OF COLORADO
DII'ARTMENT of LAw
OFii~ OF raE ATTORNL7 GIIgBAI.
it is my understanding that the permits on both quarries are
still active. However, Division files show that there has been
no production activity at either site for years.
