Figure 1, submitted with the Technical Revision 1, presents the current <br />permitted mining limits and the proposed revision to the limit. On inspection of this figure, the <br />Division felt there might be an azea of mining in the northeast and east-central portion of the <br />mining azea that extended beyond the permitted limit. This letter confirms my explanation at our <br />meeting that this area is not a mining excavation. Rather, the disturbed area includes the product <br />stockpiles on the east side of the process plant azea. The disturbed area in the northeast portion <br />of the area appears to have been the location of an overburden stockpile that has since been used <br />in the reclamation. You and I also confirmed that these azeas are within the permitted affected <br />area of the operation, therefore, the stockpiles would be allowed in these areas. <br />Please call me at 303.657.4425 if you have any other questions related to this issue. <br />Best Regards, ~, <br />Duane W.
