Stevens and is more particularly described as follows; <br />136.83 acres of land situated in the Northeast Quarter (PiEl/4) of Section Twelve (12), Township <br />One (1) North, Range Sixty-seven (6'nWest of the 6th Y.:~J, County of'~Veld, State of Colorado, <br />included as a part of Lot B of Recorded Exemption No: ] 469-12-1-RE 1525, as per the map recorded <br />January 6, 1994 in Book 1421 under Reception No. 2367922, being a part of the Southeast Quarter <br />(SEl/4) of Section One (1) and the Northeast Quarter (I~rE]/4) of Section Twelve (12), both being in <br />Township One (1) North, Range Sixty-seven (67} West of the 6th P.M., County of Weld, State of <br />Colorado. <br /> <br />This letter is intended to be our official notice to you that Lafarge West, Inc. has no legal <br />right to enter this property and no operational agrecment to mine the property. <br />As the owner of this property, we believe and maintain that the Option given to Mobile Premix <br />Concrete, Inc. dated,Lfay 19, 1999 is terminated by operation of the language and provisions <br />therein and the absence of an operational Gravel Lease. <br />We have no objection to Lafazge West, Inc. applying for and including this property in the <br />permit application, provided however, that the we as owners of said property aze held harmless <br />and indemnified in ~~ziting by LaFazge West, Inc. from any obligation or liability inherent in the <br />approval process and provided that the property may be w2thdrawn by the o~wers at any tune in <br />the future without liability in the event that an operational grsvel lease agreement is not obtained <br />between the parties. <br />Sincerely, <br />hfarg east t V.
