Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division received an objection letter from Kate C Fay & Associates, Inc. on July 28, 2004 <br />regazding the Ula pit conversion application. The letter was received on July 28, 2004, the last <br />day to submit objections, so the objection is considered timely pursuant to requirements of Rule <br />1.7. <br />Ms. Fay provided an attachment listing other names of potential objectors. Your name appeared <br />on the list, however, you did not sign the letter. Since you did not aclrnowledge the objection (by <br />signing the letter), you aze not currently considered a party to this action. You can become a <br />party by sending in a sepazate objection letter or by submitting a copy of Ms. Fay's letter with <br />your signature on it. It is imperative that you submit the appropriate objection document by <br />August 19"' because the Division now has a hearing process that must be complied with. The <br />pre-hearing conference must be held within 30-days after the close of the public comment period <br />(by August 27a'). The 120-day review date expires on September 26, 2004 so the Board hearing <br />must be scheduled prior to this date (will schedule for the September 22-23, 2004 regulaz <br />hearing, unless otherwise extended). <br />The pre-hearing conference and the Boazd hearing will be held in Denver. Date and time of the <br />pre-hearing conference will be provided as soon as it is finalized. <br />Mr. Berhan Keffelew, Environmental Protection Specialist, will be assigned lead specialist for <br />this project since I am retiring at the end of the month.
