Highwalls may be mined vertically, and later backfilled to 3:1 for reclamation. Operator cannot <br />adversely affect significant structures by this type of mining. <br />2. Phases will be mined in d~erent order, as proposed in revision submittal. Operator must follow this <br />order, acrd reclaim contermporaneously (highwalls) as proposed Operator cannot mine deeper, <br />exposing grourulwater, without amending permit. <br />3. Wash pond wit! be backfil[ed and elimistaet~ unless documentation is submitted showing approval for <br />existence ofa pond, from appropriate water authority. <br />The terms of the Teclnrical Revision No. 1 approved by the Division are hereby incorporated into Permit No. M-1994- <br />005.
