Technical Revision RECEIVED <br />Coal Creek Sand Resource <br />M-1988-044 MAR 1 3 2002 <br />Date: March 2002 <br />Division of Minerals and Geology <br />Reason for Technical Revision: <br />On January 17, 2002, Al Amundsen of the Colorado Division of Minerals Geology, performed an <br />inspection of this site. This inspection was in response to a request by the Colorado Board of Land <br />Commissioners, who is the land owner and who leases the property to Schmidt Construction. The Board of <br />Land Commissioners desired to have an inspection to determine whether the operation is in compliance with <br />the Reclamation Permit. <br />In the course of conducting the inspection, Mr. Amundsen found two problems. One was a physical <br />problem related to a fuel tank and its containment berm. The other problem related to the amount of <br />disturbance and a belief that the bond might be insufficient to cover the reclamation costs for the operation. <br />The primary focus of this revision is with regard to a discussion of the compliance of the operation and the <br />adequacy of the bond. The actual requirement for the Technical Revision is stated on page 4 of Mr. <br />Amundsen's inspection report and is stated as follows: <br />2. The affected azea appears greater than that allowed in the approved <br />reclamation permit. <br />Please provide the Division with a Technical Revision to the <br />reclamation permit which indicates the affected acreage, the acreage under <br />reclamation in the various states of reclamation. Include a bond calculation <br />appropriate for the Division to accomplish reclamation should the necessity <br />arise. <br />The due date was shown as March 22, 2002. <br />There was also an item 1 that required installation of leak protection for the fuel tank located at the South <br />Lowland azea. As that is not part of the technical revision, that matter is addressed under separate cover as <br />a separate issue from the question regarding adequate bonding. <br />Maps Included in this TR: <br />Three maps are included in this Technical Revision. Map 1 shows the South Lowland portion of <br />the permit. Maps 2a and 2b show the East Upland portion of the permit. Map 2a shows the entire upland <br />azea, including the West Upland which has never been disturbed. Map 2b show the primary operational <br />areas of the East Upland. <br />Each of the maps shows the affected and reclaimed lands on the site. The reclaimed lands, of <br />course, are actually affected land, but the distinction used here is that affected land means land that has <br />been disturbed but is not reclaimed to any significant extent. Reclaimed land means land that has at least <br />been graded. Also shown aze the more significant stockpiles of overburden and soil. There are a number of <br />smaller stockpiles scattered about that were not included in the estimates. The various features within the <br />processing site aze not distinguished and are combined into a single affected land zone. Also shown aze the <br />two wetland mitigation sites. <br />Each of the individual disturbances (whether disturbed or reclaimed) is identified. Locations <br />identified with "W" indicate wetland mitigation aeeas. An "R" indicates land that has been reclaimed to <br />some extent. And an "M" indicates land that is currently disturbed and involved in some way in the actual <br />Page 1 of 8 <br />
