J. J. Dudash - 2 - February 11, 1999 <br />Additionally, two rock raises or shafts will be excavated to provide adequate ventilation to the <br />working areas. The rock excavated from the rock slopes will be permanently stored in rooms <br />excavated specifically for that purpose. Appropriate approvals will be obtained from MSHA for <br />both driving the slopes and storing waste rock underground. <br />It should be noted the mine plan submitted with the original permit application anticipated mining <br />in both the east and west pods. The mine plan was subsequently revised to show mining in the <br />east pod only based on the anticipation of obtaining the Federal coal lease. <br />2.03.6 Right of Entrx <br />All mining will be performed within the current permit boundary and within BRL fee surface and <br />coal. <br />2.05 Production <br />The maximum permitted production provided for in the permit is 2.0 million tons per year. The <br />Mine Plan, Map 14, presents a schedule that equates to a production of about 1.2 million tons per <br />year. Year 2 on the mine plan map only shows 864,000 tons of production because that is the <br />extent of the room and pillar coal available in the private fee coal property. <br />2.05.6 Subsidence <br />The subsidence section of the permit is resubmitted in the same form as was presented with the <br />now retracted technical revision application TR-07. Changes were made to the sections dealing <br />with mining through the fault. A table was included with the TR-07 package that listed springs <br />and ponds in the permit and surrounding area along with the overburden at each feature. This <br />table is not included with this transmittal. In lieu of the table, the discussion was restricted to <br />what is included in the approved permit which is the effect subsidence may have on Pond 1 and <br />Pond 2. The subsidence section was renumbered beginning with page number 100 to allow the <br />other sections to expand during the upcoming pennit revision process. Pages 83 through 99 are <br />temporarily blank. <br />Exhibit 15 Subsidence <br />This exhibit is resubmitted in the same form as was presented with the now retracted technical <br />revision application TR-07. Changes were only made on page 18 regarding subsidence <br />implications of faults. The subsidence handbook was revised to state the DMG would be notified <br />within ten (10) days of any subsidence related damage to ponds or springs. A notation was made <br />that appropriate sign(s) will be posted to warn the public of potential subsidence damage to roads <br />and trails. <br />
