CatranY <br />Divisim Directs <br />NaNral Resource Trustee <br />Enclosed is the Division's reclamation cost estimate for the 2005 Midterm Permit Review for the <br />Bowie No. I Mine. The new liability is $5,756,607.00. This is $4,683.00 less than the current <br />liability of $5,761,290.00. The Division currently holds bond in the amount of $5,761,290.00. <br />If Bowie Resources LLC wishes to get back the excess bond of $4,683.00, only the cost of those <br />reclamation tasks that were not involved in the recent partial Phase One Bond Release (SL-2) can <br />be considered for the reduction. Rule 3.03.1(2) states the phases of bond release and the <br />maximum amount releasable for each phase. The Division has always interpreted this to mean <br />that once the 60% for Phase I has been released, the Division can never adjust a bond downward. <br />This is because the Division would then be releasing more than the 60% (similarly for the 15% at <br />Phase II). <br />Please inform the Division in writing whether or not the cost estimate is acceptable.
