On November 6th, the Division received application for TR-01, requesting the exchange of 5.60
acres of permitted and undisturbed land for 5.60 acres of lands not previously permitted for the
Hindmarsh Sandstone permit. -The request was accompanied by check number 1055 in the
amount of $188. Generally, a request to add new land area to a permit constitutes an
Amendment per Rules 1.1(6) and 1.10, and a request to remove land area from a permit
constitutes a release request per Rule 4.17. However, the Division can proceed with the
requested modified process for land exchange with the following conditions:
1. Mesa Sandstone shall submit the request for the new 5.60 acres on an Amendment
application form. The form must include all applicable exhibits for the new land area. Mesa
Sandstone shall notice according to the standard notice requirements for an Amendment. The
Operator has submitted the $188 Technical Revision fee. Therefore, the $1938 Amendment
application fee will not initially be required. However, if the Division receives a timely objection
to the application, the Operator shall be notified and required to provide the remainder of the
standard fee for an Amendment as soon as possible, but prior to the Division's recommendation
date. If the required Amendment fee is not received by the Division's recommendation date, the
Division shall recommend that the application be denied.
2. Mesa Sandstone shall submit the request to remove the undisturbed 5.60 acres as a
standard release request in accordance with Rule 4.17. The release of the area to be deleted
must be approved prior to the approval of the modified process described above under item 1.
