<br />Mr. Kent Gorham <br />September I, 1998 <br />Page 2 <br />For the light-use road to the water tanks, the requirements for vertical alignment (4.03.3(3)(a)) <br />appear to grandfather pre-existing light-use roads which is what the water tank road is. This <br />road was built sometime in the early 1950s and was constructed to fit the terrain and drainage <br />of this side canyon. Redesign and construction of this road would result in significant <br />disturbance to native ground on steep slopes which would cause a potential for increased <br />sedimentation. Over the years, the existing road has preformed adequately in terms of drainage <br />control and maintenance of the running surface. As a result, Picketwire requests that the <br />Division approve the existing alternative design for this road. <br />The second issue deals with the statement provided by Basin concerning road certification. <br />Basin's engineer was confused about the elimination of haul roads on the New Elk Property. <br />As a result, the "Relevant Showing" statement has been revised to include both haul and access <br />roads. This statement is attached. <br />Formatting Issues <br />a. Pages 2.05-5 l a and 2.05-5 l b are attached as a two-sided page. <br />b. The page number on 2.05-90e has been corrected. <br />c. Pages 2.05-10, 2.05-14b, 2.05-21, and 2.05-22 are attached as one-sided pages. <br />d. Dividers for Exhibits 33, 34, and 35 are attached. <br />e. Figure 17A was meant to be Map 17A as currently listed in the Table of Contents. The Figure <br />has been revised as a Map. <br />The cover pages for Exhibits 15, 19, and 30 have been revised to update the Table of Contents <br />within each Exhibit. Divider pages within the Exhibits are also provided for each section. <br />g. The 1995 RDA stability analysis should be placed in Exhibit 30 as indicated. <br />h.
