PART 11 <br />Page 19 <br />Permit No. COG-500000 <br />A. MANAGEMENT REQUIREMENTS <br />9. I.1inimi7ation of Adverse Im¢act <br />The permittee shall take all reasonable steps to minimire any adverse impact to waters of the State resulting from <br />noncompliance with any effiueat limitations specified in this permit, including such accelerated or edditiotral ttto¢itoring <br />as necessary [o determine the nature and impact of the noncomplying discharge. <br />10. Discharee Point <br />Any discharge to the waters of the State from a point source other than specifically authorized by this permit is <br />prohibited. <br />11. Reduction. Iwtics, or Failure of Treatment Facility <br />The permittee has the duty to halt or reduce any activity if necessary to maintain compliance with the effluent <br />limitations of the permit. Upo¢ reduction, loss, or failure of the treatment facility, the petmittee shall, to the extent <br />necessary to maintain compliance with its permit, control productio¢, or all discharges, or both u¢til We facility is <br />restored or ao alternative method of treatment is provided. 'This provision for example, applies to power failures, <br />unless m alternative power sottrce sufficient to operate the wastewater control facilities is provided. <br />It shall dot be a defertse for a permittee in m enforceme¢t action that it would be necessary to halt or reduce the <br />permitted activity in order to maintai¢ compliance with the conditions of Wis permit. <br />12. Prover Oceration and 1lfaintertance <br />The permittee shall at all times properly operate and maintain all facilities and systems of treatment and control (and <br />related appurtenances) which are installed or used by the permittee to achieve compliance with the conditions of this <br />pertnil. Proper operatoo¢ and maintenance includes effective performance, adequate funding, adequate operator staffing <br />and training, and adequate laboratory and process controls, including appropriate quality assurance procedures. This <br />provision requires the operatoo¢ of back-up or auxiliary facilities or similar systems only whey necessary to achieve <br />compliance with the conditions o(the permit. <br />RESPONSIBILITIES <br />1. Instrections and Ri¢ht to Entry <br />The permittee shall allow the Director of the State Water Quality Control Divisio¢, the EPA Regional Administrator, <br />and/or their authorized representative, upo¢ the prese¢tation of credentials: <br />a. To enter upo¢ the permittee's premises where a regulated facility or activity is located or in which any records. <br />are required to be kept udder the terms and conditions of this permit; <br />b. At reasonable times to have access w and wpy any records required to be kept udder the terms and conditions <br />of this permit and to inspect any monitoring eyuiptneot or monitoring method required in the permit; and <br />c. To enter upon the permittee's premises to investigate, within reason, any actual, suspected, or potential source <br />of water pollution, or a¢y violation of the Co{orado Water Quality Control Act. The investigation may include, <br />but is dot limited to, the following: sampling of any discharge and/or process waters, the taking of <br />photographs, interviewing permittee staff o¢ alleged violations, and access to any add all facilities or areas <br />within the permiltee's premises that may have any effect o¢ the discharge, permit, or alleged violalio¢. <br />d. The Divisio¢ shall split any sample Taken with the permittee if requested to do so by the permittee. <br />
