Severe Property Damage: Substantial physical damage to property at the treatment facilities which causes them <br />to become inoperable, or substantial and permanent loss of natural resources which can reasonably be expected <br />to occur io the absence of • bypass. It does not mean economic lose caused by delays is production. <br />c. Spill: An uniateatioml release of solid or liquid materiel which tray cause pollution of state waters. <br />d. Upset: An exceptional incident in which there is unintentional and temporary noncompliance with permit <br />effluent limitations because of factors beyond the reasonable control oC the permittee. An upset does not include <br />noncompliance to the ezteat caused by operational error, improperly designed treatment facilities, inadequate <br />treatment facilities, lack of preventative maintenance, or careless or improper operation. <br />Nonwmoliance Notification <br />e. If, for any reason, the permittce does not comply with or will be unable to comply with any discharge <br />limitations or standards specified in Wis permit, the perarittee shall, at a minimum, provide the Water Quality <br />Control Division and EPA with the following information: <br />1) A description of the discharge and cause ofnoncompliance; <br />2) The period of noncompliance, including exact dales and times and/or the anticipated lime when the <br />discharge will return to compliance; and <br />3) Steps being taken to reduce, eliminate, and prevent recurrence of the noncomplying discharge. <br />b. The permittee shall report the following instances of noncompliance orally within twenty-four (241 {roars from <br />the time the pertrrittce becomes aware of the noncompliance, and shall mail to the Division a written report <br />within five (5) davs after becoming aware of the noncompliance: <br />1) Any instance of noncompliance which may endanger health or the environment; <br />2) Any unanticipated bypass; <br />3) Any upset which causes an exceedance of any effluent limitation in the permit; <br />4) Any spill which causes any effluent limitation to be violated; <br />5) Daily maximum violations for any toxic pollutants or hazardous substances limited by Pact 1.13 of this <br />permit and specified as requiring 24 hour notification. <br />c. The permittee shall report all other instances of non-compliance not requiring 24-hour notification at the time <br />Discharge Monitoring Reports are submitted. The reports shall contain the information listed in sub-paragraph <br />(a) of this section. <br />4. Submission of Incorrect or Incomolele Information <br />Where the permillce failed to submit any relevant facts in a permit application, or submitted incorrect information in a <br />permit application or report to the Division, the permittce shall promptly submit the relevant application information <br />which was not submitted or any additional information needed to corm{ any erroneous informatioh previously <br />submitted. <br />5. )ir ass <br />The pemrittee tray allow any bypass to occur which does not cause effluent limitations to be exceeded, but if and only <br />
